1. Acceptance of Terms

Welcome to BetterKids! These Terms of Service ("Terms") govern your access to and use of the BetterKids mobile application and website (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

IMPORTANT: If you are under 18 years old, your parent or legal guardian must review and accept these Terms on your behalf before you use the Service.

2. Eligibility

The Service is intended for use by children under the supervision of their parents or legal guardians. By creating an account:

• You represent that you are the parent or legal guardian of the child using the Service
• You have the authority to bind the child to these Terms
• You are at least 18 years old
• You agree to supervise your child's use of the Service

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities under your account

4. Premium Subscription

4.1. Subscription Plans

BetterKids offers premium subscription plans:

• Monthly Subscription: $9.99 per month
• Annual Subscription: $99.99 per year (approximately 17% savings)

iOS (Apple App Store):

1. Open Settings on your iPhone/iPad
2. Tap your name at the top
3. Tap "Subscriptions"
4. Select BetterKids
5. Tap "Cancel Subscription"

Android (Google Play):

1. Open Google Play Store
2. Tap Menu → Subscriptions
3. Select BetterKids
4. Tap "Cancel Subscription"

4.4. Refund Policy

All purchases are final. We do not offer refunds for partial subscription periods. If you cancel your subscription, you will retain access to premium features until the end of your current billing period.

Apple/Google Refund Requests: If you believe you are entitled to a refund under Apple's or Google's terms, please contact them directly through their respective support channels.

4.5. Free Trial (if applicable)

If a free trial is offered, you may be automatically enrolled in a paid subscription at the end of the trial period unless you cancel before the trial ends. We will notify you before any charges are made.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Upload inappropriate, offensive, or harmful content
• Impersonate any person or entity
• Interfere with the Service's operation
• Attempt to gain unauthorized access to the Service
• Use automated systems (bots) to access the Service
• Share your account with others outside your household
• Reverse engineer or decompile the Service

6. User Content

6.1. Your Content

You may upload photos, videos, and other content ("User Content") to the Service. You retain ownership of your User Content, but you grant us a license to use it for operating the Service.

6.2. Content License

By uploading User Content, you grant BetterKids a non-exclusive, worldwide, royalty-free license to use, store, display, and process your User Content solely for the purpose of providing the Service, including:

• Generating educational content and analysis using AI
• Storing and displaying your child's progress and achievements
• Providing school update features

6.3. Content Restrictions

User Content must not:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Contain malware or harmful code
• Be inappropriate for children
• Violate anyone's privacy

6.4. Content Removal

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable. You can delete your User Content at any time through the app settings.

7. Intellectual Property

The Service, including its content, features, and functionality, is owned by BetterKids and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute the Service
• Use our trademarks without permission
• Create derivative works based on the Service
• Sell or redistribute any part of the Service

8. Affiliate Program

BetterKids operates an affiliate referral program. By participating, you agree to:

• Not engage in fraudulent referrals or activities
• Follow all promotional guidelines
• Accurately represent BetterKids
• Not spam or use deceptive marketing practices

Affiliates earn 30% commission on referred subscriptions. We reserve the right to terminate affiliate accounts for violations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTERKIDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of profits or data
• Service interruptions
• Unauthorized access to your account
• Errors in AI-generated content

Our total liability for any claims shall not exceed the amount you paid for the Service in the 12 months prior to the claim.

11. Term and Termination

11.1. Term

These Terms remain in effect while you use the Service.

11.2. Termination by You

You may terminate your account at any time by contacting support or deleting your account through the app.

11.3. Termination by Us

We may suspend or terminate your account if you violate these Terms or for any other reason at our sole discretion.

11.4. Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and User Content
• You will not be entitled to a refund for any unused subscription period
• Provisions that should survive termination (e.g., disclaimers, limitations of liability) will remain in effect

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Sending an email notification
• Displaying an in-app notification

Your continued use of the Service after changes constitute acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of Vietnam. Any disputes shall be resolved in the courts of Vietnam.
